Baby suffers brain injury from delivery

If you watch T.V., it sometimes appears as if child birth is routine and comes with few risks. In reality, there are many things that can go horribly wrong during labor and if they do, it can result in devastating injuries for the baby and/or the mother. This unfortunately was the case for a baby in Massachusetts who suffered a life altering brain injury due to asphyxia (lack of oxygen) during birth. The baby’s parents alleged that the mother’s obstetrician/gynecologist failed to properly monitor the birth and manage potential complications during the birthing procedure causing their baby to suffer a serious brain injury.

Specifically, after the baby began showing signs of distress, the parents, through legal counsel, alleged that the defendants should have ordered an emergency C-section instead of letting the mother continue with a vaginal delivery of the baby.

By ordering a C-section after signs of fetal distress became clear, the parents argued that their baby’s injury would have been avoided. The defendant argued that the clinical presentation did not provide sufficient grounds for an immediate C-section and that once signs of fetal distress became known, the defendant properly ordered a c-section.

The defendant further attempted to challenge the parents’ claims as to the cause of the baby’s injuries, arguing that an underlying congenital diaphragmatic / pulmonary condition  likely contributed to the baby’s injury during birth.
