Construction site accident in Boston injures two

Boston Construction Site Accident

Emergency personnel responded to a construction accident at 45 Stuart St. this morning, according to the Boston Fire Department.

Boston EMS treated 2 on the scene. One was brought to Tufts Medical Center with a serious head injury, and the other was hospitalized for a minor injury, according to Boston Fire. The injuries resulted from a partial collapse to the upper floors of a building under construction.

Floor 12 collapsed down to the fifth floor of the building, which is planned to be a 33 story structure, according to the Boston Fire Department.

Construction site accident cases like the Stuart Street collapse, can be complex. Many times, construction site accidents involve several contractors or subcontractors, with each playing at least a partial role in the incident. In addition to having multiple potential defendants, construction site cases usually involve various claims by contractors and subcontractors against each other seeking contribution and/or indemnification for any potential damages.

Construction site accident cases are usually amenable to resolution and financial settlement through mediation and/or arbitration, which allows the parties to avoid potentially costly and protracted litigation in court. There are a few factors that allow this:

  1. There are usually multiple parties involved with each being able to contribute and share in the settlement;
  2. The plaintiff is an injured worker; and
  3. There are numerous codes and regulations that will be applicable to the incident and violations of these codes and regulations make for a very difficult defense.
